1. Agreement to Terms

By requesting a quote, submitting a booking form, or renting equipment from Dumpster Solutions LLC ("Company," "we," "us," or "our"), you ("Customer") agree to these Terms of Service. If you do not agree, do not use our services.

2. Services

Dumpster Solutions LLC provides roll-off dumpster rental services in Lake & Geauga Counties in Ohio. Services include delivery, rental, and pickup of 20-yard dumpsters for residential and commercial use.

3. Rental Terms

3.1 Rental Period Rental periods are 3, 7, 10, or 14 days as selected at the time of booking. The rental period begins on the confirmed drop-off date.

3.2 Extensions If you need to extend your rental beyond the agreed period, you must contact us prior to the scheduled pickup date. Extension availability is not guaranteed and additional charges may apply.

3.3 Access Requirements Customer is responsible for ensuring clear truck access to the drop-off location. Failure to provide adequate access may result in rescheduling fees or cancellation.

3.4 Placement The dumpster must be placed on the Customer's property or in a location for which the Customer has obtained any required permits. Dumpster Solutions LLC is not responsible for obtaining street or right-of-way permits. Any fines or fees resulting from improper placement are the Customer's responsibility.

4. Acceptable and Prohibited Materials

4.1 Acceptable Materials Household junk, furniture, construction debris, and similar non-hazardous materials. Yard waste is accepted only as a dedicated load and may not be combined with other materials in the same dumpster.

4.2 Prohibited Materials The following materials are strictly prohibited and may not be placed in any dumpster:

• Tires
• Hazardous materials of any kind
• Paint, solvents, or chemicals
• Appliances containing freon (refrigerators, air conditioners, freezers)
• Batteries (automotive or industrial)
• Asbestos or asbestos-containing materials
• Medical or biohazardous waste
• Electronics (unless otherwise agreed in writing)
• Flammable or explosive materials
• Any material prohibited by local, state, or federal law

Customer agrees to indemnify and hold harmless Dumpster Solutions LLC for any fines, penalties, or disposal costs arising from prohibited materials found in the dumpster.

5. Weight Limits and Overage

Each rental includes a maximum weight allowance of 4 tons. Overweight fees of $50 per ton apply to loads exceeding this limit. Customer is responsible for all overweight charges, which will be invoiced separately.

6. Damage and Liability

6.1 Property Damage Customer assumes all risk of damage to driveways, landscaping, or other property resulting from dumpster placement or removal. Dumpster Solutions LLC recommends placing plywood under the dumpster to minimize surface damage but is not liable for any property damage.

6.2 Damage to Equipment Customer is responsible for damage to the dumpster caused by improper use, overloading, or prohibited materials. Repair or replacement costs will be invoiced to the Customer.

7. Cancellations and Rescheduling

Cancellations must be made at least 24 hours before the scheduled drop-off time. Late cancellations may be subject to a cancellation fee of $25. Rescheduling is subject to availability and must be requested at least 24 hours in advance.

8. SMS and Electronic Communications

8.1 Transactional Messages By providing your phone number at the time of booking, you consent to receive transactional text messages from Dumpster Solutions LLC related to your rental, including booking confirmations, drop-off reminders, pickup reminders, and service updates. These messages are necessary to fulfill your rental and are sent via an automated messaging system.

8.2 Promotional Messages By checking the SMS opt-in box on our booking form, you provide express written consent to receive promotional text messages from Dumpster Solutions LLC, including availability updates, special offers, and follow-up communications. This consent is not a condition of purchasing any service.

8.3 Opt-Out You may opt out of promotional text messages at any time by replying STOP to any message. You may also opt out by contacting us directly at 440-668-4577 or admin@mydumpstersolutions.com. Transactional messages related to an active rental may continue until your rental is complete.

8.4 Message Frequency and Rates Message frequency varies based on your rental activity. Standard message and data rates may apply depending on your wireless carrier and plan.

8.5 Sending Hours We send automated messages only between 8:00 AM and 9:00 PM Eastern Time in accordance with applicable regulations.

9. Payments

Payment is collected at the time of service or as otherwise agreed with Dumpster Solutions LLC. We reserve the right to require payment prior to delivery. Invoices not paid within 7 may be subject to a late fee of $25 or referral to collections.

10. Governing Law

These Terms are governed by the laws of the State of Ohio. Any disputes arising under these Terms shall be resolved in the courts of Geauga County, Ohio.

11. Limitation of Liability

To the maximum extent permitted by Ohio law, Dumpster Solutions LLC's total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid for the rental giving rise to the claim.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on our website with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
